Can Florida Doctors Order Medical Marijuana?

YES.      Florida doctors can order medical marijuana for their patients. In June 2014, Florida signed into law the ‘Charlotte’s Web’ bill, which legalized certified physicians to order low-THC marijuana for medical use in a select group of qualified patients. In 2016, 71% of Florida voters approved the Amendment 2 ballot initiative, which became effective in January 2017. The Amendment widely expands on the initial bill, granting the medical use of marijuana by any qualified Florida resident. Initially, terminally ill patients diagnosed by two doctors to have less than a year to live were given full-strength cannabis. The scope of diagnoses has been dramatically expanded to include a more extensive set of patient conditions.

Florida physicians must hold an active, unrestricted license as either an allopathic physician or osteopathic physician and take an annual course and exam to recommend medical marijuana. Medical cannabis orders, recommendations, certifications, or authorizations are not technically ‘prescriptions’ as the prescriptive authority for physicians; the Drug Enforcement Agency (DEA) does not recognize medical marijuana as medicine.
